Terms of Service

Acceptance

By accessing or using GigaFleet, you agree to these Terms. If you use the service on behalf of an organization, you represent that you are authorized to bind that organization.

The service

GigaFleet is a fleet-operations platform for waste haulers and municipalities, including dispatch, routing, field and driver applications, client portals, analytics, and compliance reporting. Specific features and service levels are as described in your order or written agreement with us.

Accounts

You are responsible for providing accurate account information, safeguarding your credentials, and for activity that occurs under your account. Notify us promptly of any unauthorized use.

Your data

You retain ownership of the operational data you submit to the platform. You grant us the rights necessary to host, process, and display that data to provide the service. You are responsible for ensuring you have the right to submit the data, including any personal information of drivers, residents, or contractors, and for using the service in compliance with applicable law.

Acceptable use

Availability

We aim to provide a reliable, highly available service and may perform scheduled maintenance. Any committed service levels (SLAs) are set out in your written agreement. Except as expressly stated there, the service is provided “as is.”

Fees

Fees, billing, and payment terms are as set out in your order or agreement with us.

Intellectual property

The GigaFleet platform, software, and marks are owned by Giga Enterprises and its licensors. These Terms do not grant you any rights in them except the limited right to use the service.

Disclaimers

Except as expressly stated in a written agreement, the service is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, Giga Enterprises will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the service.

Termination

You may stop using the service at any time. We may suspend or terminate access for violation of these Terms or as set out in your agreement. Certain provisions survive termination, including ownership, disclaimers, and limitations of liability.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles.

Changes

We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
